TERMS 

Rec Club – Sports Participation Waiver & Terms 

1. Acknowledgment of Risks
Signing up digitally you hereby acknowledge and agree that participation in sports and recreational activities at Rec Club involves inherent risks, including but not limited to:

• Physical injury, including fractures, sprains, concussions, or other bodily harm.

• Illness or medical conditions, including those triggered by exertion, excitement, or physical impact.

• Exposure to equipment, playing surfaces, and interactions with other participants that may result in harm.

• Unforeseen incidents, including but not limited to falls, collisions, or exposure to communicable diseases.

 

2. Code of Conduct
I understand that the player registering is bound by the rules and Code of Conduct of The Rec Club (a copy of which is available on request).

3. Assumption of Risk
I understand and voluntarily assume all risks associated with participating in sporting activities at Rec Club, including risks that may arise due to negligence, unforeseeable events, or acts of third parties. I acknowledge that Rec Club, its owners, directors, staff, and affiliates are not responsible for any injuries, damages, or losses incurred while participating.

 

4. Medical Fitness and Consent to Treatment
I affirm that I am physically fit and have no medical conditions that would prevent safe participation. I consent to receive medical treatment in the event of injury and accept responsibility for any medical expenses incurred. There may be no or inadequate treatment or transport available to the player if injured. I permit The Rec Club to arrange for any medical attention (including ambulance transport) that may be deemed necessary for the player.

 

5. Release and Indemnity
To the fullest extent permitted by law, I release, waive, and discharge Rec Club, its owners, directors, staff, volunteers, agents, and affiliates from any liability, claims, demands, or causes of action arising from participation. I further agree to indemnify and hold harmless Rec Club from any claims, damages, or expenses resulting from my participation.

 

6. Compliance with Rules and Safety Instructions
I agree to abide by all Rec Club rules, safety instructions, and policies. I acknowledge that failure to comply may result in removal from the facility without refund.

 

7. Minors and Parental Consent
For participants under 18 years old, a parent or legal guardian must sign this waiver, acknowledging the risks and responsibilities outlined herein.

 

8. Player Insurance
I acknowledge and understand that The Rec Club carries only minimal players’ insurance (a copy of which is available on request). It is my responsibility to arrange adequate insurance cover.

9. Refunds & Credits
Once registered for our competitions we do not offer a refund. If you as a single player or your team is ejected from the competition or program, you will not be offered a refund for any remaining games.

I understand that once registration fees have been paid, any later refund requested will be subject to an administration fee of $50 and game fees for games already played will be deducted from any refund amount RC reserves the right in its absolute discretion to decline a request for refund after the first four (4) weeks from commencement of the season.

For School Holiday Camps or Clinics, a refund will not be offered. You may however be offered a credit to use towards future camps if enough prior notice is given. 

10. Photography  and Videography Policy
I acknowledge that RC takes photographs/videos of various activities for marketing purposes (including social media) and consent to the player’s name and/or photo being published by RC from time to time.

Should any person take objection to the photographing or videoing of players, they should communicate their concerns to an RC representative including the reason for the objection. Decisions affecting this policy are taken on a case-by- case basis.

11. Governing Law and Jurisdiction
This agreement is governed by the laws of New South Wales and applicable federal legislation, including but not limited to:

• Civil Liability Act 2002 (NSW) – Limits liability for recreational activities.

• Australian Consumer Law (ACL) – Recognizes waiver of liability in voluntary activities.

• Work Health and Safety Act 2011 (NSW) – Ensures duty of care for premises and activities. I acknowledge that this waiver may be used in any legal proceedings in any court within the jurisdiction.

 

12. Acknowledgment 
I HAVE READ AND FULLY UNDERSTAND THIS WAIVER AND RELEASE OF LIABILITY. I VOLUNTARILY AGREE TO ITS TERMS.
